Fondle an Eight-year-old, Get Probation

A Pop Warner football coach pleads guilty to fondling an 8-year-old up to nine times. The California Department of Corrections evaluated him and recommended a state prison term. The prosecutor recommended eight years.

The judge gives him probation:

A Monterey County Superior Court judge Thursday sentenced former youth sports coach David Martin to five years of felony probation for molesting an 8-year-old girl. “If you violate your probation at all … you’re on your way to prison for eight years,” Judge Richard Curtis told Martin as half a dozen people listened closely from the audience.Martin, 43, a longtime Pop Warner football and Atlantic Little League coach in Salinas, was arrested Aug. 18, 2006, after the girl’s parents told police he had inappropriately touched her seven to nine times beginning in late May of that year. Some terms of the probation include:

  • Registering as a sex offender, under which he could be subject to lifetime GPS monitoring.
  • Not coaching or attending youth sports activities.
  • Paying restitution to the family for costs of counseling.
  • Possessing no sexually explicit materials.
  • Staying at least 200 yards from the girl and her family.
  • Living 2,000 feet from places children congregate, such as parks and schools.
  • Staying away from any place alcohol is served.
  • Attending a sex offenders’ treatment program.
  • Gosh. That’s almost harsh. Well, not really. That is a disgrace.
